*** HARSH BUNGER, J. (Oral) The instant Writ Petition has been filed under Articles 226/227 of the Constitution of India inter alia seeking issuance of a writ in the nature of Mandamus for directing respondent No.2 to issue passport in the name of the petitioner.

Learned counsel appearing for the respondent(s)-Union of India informs the Court that the trial in one case F.I.R. No.126, dated 26.11.2022 under Sections 120-B, 302 read with Section 34 of the Indian Penal Code and Sections 25, 54 and 59 of the Arms Act, 1959, registered at Police Station Baldev Nagar, Ambala District, Ambala; is pending against the petitioner.

2.1 Learned counsel for the respondent(s)-Union of India further submits that the petitioner was issued a letter dated 22.11.2024 by the Regional Passport Office, Chandigarh seeking certain clarifications, HIMANI GUPTA 2025.01.31 09:19 I attest to the accuracy and authenticity of this document/judgment High Court, Chandigarh

CWP-1348-2025 (O&M) -2however, the same has not been responded to, by the petitioner. 2.2 It is further submitted that, in case, the petitioner responds to the clarifications as sought by the Regional Passport Officer, Chandigarh, vide the aforesaid letter dated 22.11.2024 and also produces the permission from the concerned Court where the trial of F.I.R. No.126, dated 26.11.2022 is pending, in terms of notification No.570(E) dated 25.08.1993, issued by Ministry of External Affairs, Government of India, the application seeking issuance of the passport, submitted by the petitioner would be processed in accordance with law.

Learned counsel for the petitioner, in view of the aforesaid stand taken by learned counsel appearing for the respondent(s)-Union of India, submits that he may be permitted to withdraw the instant writ petition at this stage with liberty to the petitioner to respond to the clarifications as sought by the Regional Passport Office, Chandigarh along with the permission from the concerned Court, where the trial in the aforesaid case F.I.R. No.126, dated 28.02.2022, is pending; in terms of notification No.570(E) dated 25.08.1993.

In view of the above, the present petition is dismissed as withdrawn at this stage with liberty aforesaid. 5.
