***** HARKESH MANUJA, J. (ORAL) Through this petition under Section 438 Cr.P.C. prayer has been made for grant of anticipatory bail to the petitioner, in case FIR No.15 dated 05.12.2022, under Sections 379 and 420 IPC, registered at Police Station Cyber Jind.

On 20.01.2023, this Court passed the following order:- "Learned counsel for the petitioner, inter-alia, submits that there is no other case of similar nature pending against the petitioner and in order to show his bonafide, he is even ready to reimburse a sum of Rs.1.50 lacs to the complainant.

Notice of motion for 02.02.2023.

In the meanwhile, petitioner will join investigation before the Investigating Officer as and when called and shall handover a draft of Rs.1.50 lacs to be paid to the complainant. In the event of his arrest, the Arresting Officer would admit him to interim bail, till the next date of hearing, on his furnishing adequate bail and surety bonds to his satisfaction. The petitioner is directed to abide by all the conditions as envisaged under Section 438(2) of Code of Criminal Procedure, 1973."

CRM-M-3082-2023 --2-- Today, learned counsel for the petitioner has submitted that two drafts bearing Nos.069147 and 069148 dated 31.01.2023 and 01.02.2023 respectively total amounting to Rs.1.50 lacs in the name of complainant has been handed over to the complainant in the presence of Investigating Officer on 01.02.2023.

The aforesaid fact has also been verified by learned State counsel. Having considered the aforesaid facts and circumstances of the case, order dated 20.01.2023 passed by this Court is made absolute. Disposed of accordingly.
