The instant petition has been filed under Section 483 of BNSS, 2023 for grant of regular bail to the petitioner in case FIR No.102 dated 04.05.2019 under Sections 302,148,149 IPC (Sections 341 and 201 IPC added later on) registered at P.S City Kapurthala, District Kapurthala. 2.

At the outset, learned State counsel submits that no doubt there has been delay in conclusion of the trial, although, an application under Section 319 Cr.P.C was moved by the prosecution for summoning certain other individual as additional accused, however, the said application was dismissed. It was impugned before this Court and this Court has upheld the order of dismissal of the trial Court. It has further been submitted on instructions that the trial is proceeding at reasonable good pace and only 12 formal witnesses remain to be examined who in all likelihood would be examined in the near future. It has also been submitted that this case is based on the eye witnesses' account wherein the petitioner has specifically been named in the FIR and attributed specific role of inflicting injuries on the person of the deceased.

After arguing for some time, learned counsel for the petitioner does not press this petition, in view of the of the stage of the trial. 4.

Dismissed as not pressed.
