SANDEEP MOUDGIL, J (ORAL) In compliance of previous order dated 16.01.2025, whereby warrant officer was appointed, a report dated 18.01.2025 has been filed by Ajay KumarWarrant Officer, the relevant part of which reads as under: "At the very out set learned counsel for the petitioner told me that petitioner will meet me near police station Sadhaura. I left Chandigarh at 12.20 pm on 17.01.2025 and reached police station Sadhaura at 2.00 pm. Petitioner meet me out side the police station. SHO Amit Kumar meet me in the police station. After disclosing my identity and purpose of visit, I ask him to provide police protection to search the detenue Kalsuman at the premises of respondent No. 4 to 10. SHO told me that FIR No. 9 dated 11.01.2025 u/s 140(3)/190/191(3)/333/251(2)/351(3) BNS police station Sadhaura (Annexure R-1) has been registered regarding kidnapping of detenue and respondent No. 4 (father of detenue) has been arrested in this case and is remanded to judicial custody.

I along with petitioner, and police party reached the premises of respondent No. 4 to 10 at village Ismailpur, Kalyanpur and Garhi Viral. All the premises were found locked and no one was found present there. MANOJ KUMAR 2025.01.19 05:40 I attest to the accuracy and authenticity of this order

CRWP-461-2025 #2# Statement of Sarpanch of village Ismailpur (Annexure R-2) has been recorded in which he has stated that house are locked for the last 4 days and no family member is present there and he will inform the police as and when anybody reached the home.

Thereafer, petition said that he does not want the search to be conducted at any other place as he does not know any other place. Statement of petitioner (Annexure R-3) to this effect has been recorded." On the other hand, learned State counsel would inform that an FIR No.9 dated 11.01.2025 stands registered with P.S Sadhaura, District Yamunanagar and due investigation is being carried out.

In the light of aforesaid, learned counsel for the petitioner prays for withdrawal of the instant petition.

Prayer is accepted.

Dismissed as withdrawn.

However, the Superintendent of Police, Yamuna Nagar shall make all endeavour monitoring the investigation personally on day to day basis so as to trace the missing detenue, at the earliest.
