**** HARNARESH SINGH GILL, J.(Oral) Prayer in this petition is for issuance of a writ in the nature of Certiorari for quashing the order dated 13.05.2022 (Annexure P-14) passed by respondent No.2 vide which the petitioner has been granted the benefit of step-up pay w.e.f. 21.09.2000 to 23.05.2013 on notional basis and actual benefits w.e.f. 24.05.2013.
Learned counsel for the petitioner submits that the petitioner was appointed as Clerk on 01.11.1993 and was allotted posting at Government Polytechnic, Sirsa; that during his service, the petitioner was transferred to several places in the State of Haryana and that the petitioner was promoted to the post of Assistant on 21.05.2013 and was posted at Government Polytechnic, Hisar. He further submits that the order granting notional pay w.e.f. 21.09.2000 to 23.05.2013 is arbitrary and without due consideration and that the Department concerned has not calculated the pay of the petitioner rightly. CWP-1470-2023 (O&M) -2that the petitioner moved a letter dated 29.06.2022 (Annexure P-16) to respondent No.2-Director, Technical Education, which was followed by a reminder dated 26.08.2022 (Annexure P-17) but the same have not been considered/decided till date.
Notice of motion to respondents No.1 to 5 only, at this stage. On the asking of this Court, Mr. RS Budhwar, Additional AG Haryana, accepts notice on behalf of respondents No.1 to 5-State only. I have heard the learned counsel for the parties. Without going into the merits of the case, the present petition is disposed of with a direction to respondent No.2-Director, Technical Education, Haryana to decide the letter dated 29.06.2022 moved by the petitioner, within a period of eight weeks, by passing a speaking order, after re-assessing the notional pay fixed and actual benefits given to the petitioner, in accordance with law.
