Ms. Jony Bansal, Advocate, for respondent No.2. RAMENDRA JAIN, J. (ORAL) In compliance of order dated 21.01.2020, learned counsel for the petitioners has produced receipts of `20,000/-. The same are taken on record. Registry is directed to verify the deposit of costs by the petitioners with the concerned quarters.
Prayer in the instant petition under Section 482 Cr.P.C. has been made for quashing FIR No.45 dated 26.06.2018 registered under Sections 323, 341, 506, 148, 149 IPC at Police Station Mulepur, District Fatehgarh Sahib, on the basis of compromise dated 28.11.2018 (Annexure P-2) arrived at between the parties.
Pursuant to order dated 21.01.2020 of this Court, the parties appeared before learned Judicial Magistrate First Class, Fatehgarh Sahib, on 06.02.2020 to get their statements recorded. Learned Judicial Magistrate First Class, Fatehgarh Sahib, has submitted his report vide letter bearing RAVINDER SINGH 2020.02.26 11:24 I attest to the accuracy and integrity of this document
-2CRM-M-2589 of 2020 No.16 dated 15.02.2020, duly forwarded by learned District and Sessions Judge, Fatehgarh Sahib, vide letter No.1185/EB dated 17.02.2020. According to the above report, parties have compromised voluntarily, with their free will and without any fear or pressure of any kind and compromise is genuine. No accused has been declared as proclaimed offender.
Therefore, in view of above and the fact that the compromise will bring peace and harmony between the parties, FIR No.45 dated 26.06.2018 registered under Sections 323, 341, 506, 148, 149 IPC at Police Station Mulepur, District Fatehgarh Sahib, and all subsequent proceedings arising therefrom, are quashed.
Disposed of accordingly.
