The ex parte order against the defendant is set aside and the defendant is allowed to continue with the trial on the statement already filed. The objection is that earlier an application had been filed by the very same defendant as though they had not been served with summons and when an objection was taken pointing out to the fact that they had been actually served and they had engaged the cousnel and the statement was filed, the previous application filed was withdrawn and fresh application was filed admitting the fact of service but merely seeking for permission to set aside the order. The Court has allowed that. I do not find any prejudice as having resulted to the plaintiff to challenge the same in the revision petition.

The revision petition is dismissed.
