-.- KARAMJIT SINGH , J. (Oral) Prayer is for grant of anticipatory bail in case having FIR No.230 dated 16.12.2020 registered under Sections 379-B/34 IPC at Police Station Bilga, District Jalandhar.

The counsel for the petitioner inter alia contends that the petitioner is falsely implicated in the present case at the instance of police officials namely Lakhwinder who was posted as SHO at Police Station Lohina at the relevant time and now he has been promoted as DSP. The counsel further submits that the petitioner has joined investigation with the GAURAV SOROT 2023.01.18 10:25 I attest to the accuracy and authenticity of this order, judgment and documents.

( 2 ) CRM-M-3844-2021 (O&M) police and the co-accused Manpreet Singh @ Manna who faced trial stands acquitted on conclusion of trial against him. State counsel on instructions from ASI Amrik Singh has admitted that the petitioner joined the investigation with the police and that co-accused Manpreet Singh @ Manna is acquitted by the trial Court on completion of trial and that the petitioner is not required by police for further investigation or for custodial interrogation and after completion of investigation supplementary challan has been presented by the police in the Court concerned.

In view of the above, without commenting on the merits of the case, the present petition is hereby allowed and order dated 28.01.2021 is hereby made absolute. The petitioner should abide by the conditions envisaged under Section 438(2) Cr.P.C.
