Mr. Amit Rana, Senior Deputy Advocate General, Punjab. MANJARI NEHRU KAUL, J. (ORAL) Prayer in this petition is for grant of anticipatory bail to the petitioner in FIR No.111 dated 03.09.2024 under Sections 406, 420 of the IPC registered at Police Station Division No.4, District Patiala. 2.

Vide order dated 21.01.2025, the petitioner had been granted interim anticipatory bail with direction to join investigation and the relevant part of the said order reads as under:- "Learned counsel for the petitioner inter alia contends that the petitioner is not the owner of the vehicles in question qua which the complainant had paid an amount of Rs.3,80,000/- to the petitioner. Furthermore, there was no documented bank transaction in support of the contentions of the complainant that the aforesaid amount of money had ever been paid to the petitioner. Learned counsel further submits that a perusal of the allegations levelled in the FIR in question at best make it out to be a civil dispute between the parties."

Learned counsel for the petitioner submits that in compliance of order dated 21.01.2025, the petitioner has joined investigation and cooperated with the investigating agency. 4.

Learned State counsel, on instructions, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioner is not required for further investigation much less for his custodial interrogation.

In view of the above, the petition is allowed and interim order dated 21.01.2025, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) BNSS.
