I find no cause for intervention in a case relating to payment of court fee where the plaintiff seeks for assailing the sale deed to get away all the consequences of the transaction, no matter that the consideration has not been passed. If the plaintiff is seeking to set aside the sale on the ground that there was no transfer of title, he is in a way trying to get over the consequences of the sale deed which he has voluntarily executed. Such a relief in suit would require court fee to be paid ad valorem on the value of the property and if the plaintiff is seeking a fixed court fee, it was not proper and if the Court below has found the same to be payable, I will find no reason for making an interference in the revision petition.

The revision petition is dismissed.
