(ORAL) The petitioners-defendants are aggrieved of the order dated 16.05.2016, whereby, evidence of defendant Nos.5 and 6 has been closed. Mr. Ashok Verma, Advocate for the petitioners submits that in case, one opportunity is granted, he will conclude the entire evidence. I have heard the counsel for the petitioners-defendants and appraised the paper book and of the view that no doubt, the petitionersdefendants were negligent in concluding the evidence. However, in order to advance justice and prevent miscarriage of justice, I deem it appropriate to grant one effective opportunity to the petitioners to conclude the evidence.

Keeping in view the aforementioned observations, the impugned order is set aside and the petitioners-defendants shall conclude the evidence in accordance with law subject to payment of costs of `5,000/- which shall be condition precedent. If the costs is not paid as directed, the order already passed by the court below shall stand restored. PANKAJ KUMAR 2016.07.

C.R. No.4334 of 2016 -2The counsel for the petitioners submits that the next date fixed before the court below is 22.07.2016 and he wants to seek assistance of the court to summon the witnesses to lead evidence. The petitioners-defendants shall move an application before the Court before the date fixed and the trial Court would allow the application and serve the summoned witnesses to lead evidence through dasti process on the date fixed. The impugned order is set aside and the revision petition is allowed.
