*** PANKAJ JAIN, J. (ORAL) The petitioner has preferred present petition under Article 226/227 of the Constitution of India seeking writ in the nature of certiorari wherein the petitioner prays for appropriate direction seeking quashing of the impugned order dated 29.10.2018 (Annexure P-6).
The whole case of the petitioner revolves around his alleged right claiming out of turn promotion. On 24.1.2020 following order was passed:- "Counsel seeks a date to place on record any Policy circular/decision at the hands of the appropriate State Government and on the strength of which the prayer in the instant writ petition for out of turn promotion has been raised.
Adjourned to 17.04.2020."
More than three years have lapsed and the said order still awaits ARCHANA ARORA 2023.01.13 17:58 I attest to the accuracy and integrity of this order/judgment
CWP No. 1934 of 2020(O&M) -2compliance. Learned counsel for the petitioner very fairly submits that as on date he has no such instructions/notification/circular on the basis of which he can claim that such right has fructified in his favour. He prays for withdrawal of the present writ petition with liberty to file a fresh one. Without commenting on delay/maintainability on such writ petition, the aforesaid prayer is allowed.
