Learned counsel for the petitioners seeks permission to withdraw the present revision petition with liberty to raise all the issues before the Executing Court in view of the fact that partition has already been effected between the co-owners. The factum of partition is disputed by the learned counsel appearing on behalf of respondent No.1. He, however, states that he has no objection if the present revision petition is disposed off with liberty to the petitioners to raise all the issues before the Executing Court. In view of the above, the present revision petition is disposed off. The petitioners are at liberty to raise all the issues before the Executing Court. Since the execution pertains to the year 2007, the Executing Court is requested to expedite the hearing and dispose off the matter as early as PARKASH CHAND 2023.02.22 16:33 I attest to the accuracy and authenticity of this order/judgment.
