(Oral) Challenge in the present revision petition is to the order dated 02.05.2017 (Annexure P-4) passed by the Appellate Authority whereby, mesne profits have been fixed at `4,000/- of the premises in question of which eviction order had been passed on 12.02.2016. The premises in question are one room, one kitchen, one bathroom alongwith veranda at the rear on the second floor of H. No. 282, Sector 40, Chandigarh. It is settled principle that once the order of eviction has been passed, mesne profits have to be paid by the tenant. It is not disputed that the rent was `1,500/- per month at the time of induction on 01.08.2006. A period of more than one decade has gone by and rent has not been increased.

In such circumstances, mesne profits which have been assessed at 4,000/- cannot be faulted with in any manner for the accommodation which is being occupied by the tenant. Accordingly, finding no merit in the present revision petition, the same is dismissed in limine. 01.06.2017 (G.S.
