M.M.S. BEDI, J (ORAL) An application under Section 10 CPC filed by the defendant- petitioner has been dismissed on the ground that the cause of action in both the cases is different though parties to the suit and nature of the claim are same.

After hearing the counsel for the petitioner, I do not find any ground to interfere in the impugned order but I am of the opinion that the civil suit between the same parties involving the similar controversy should be before the same Court and should be taken simultaneously.

This petition is dismissed without prejudice to the rights of the petitioner to move an application for transfer of both the suits to one Court for adjudication simultaneously with liberty to the trial Court to club the same in case the circumstances so warrant. (M.M.S. BEDI) July 16, 2015.
