CORAM:HON'BLE MR. JUSTICE K. KANNAN 1.
Whether Reporters of local papers may be allowed to see the judgment ?
2.
To be referred to the Reporters or not ?
3.
Whether the judgment should be reported in the Digest? -.- K. KANNAN J. (ORAL) 1.
An absolutely perverse order has been passed by the Additional District Judge in refusing to condone 7 days delay in filing the appeal and stating that each day's delay has not been explained. The Court shall learn to be more pragmatic and not fetter the right of party for an adjudication to an immovable property on such a flimsy ground. 2.
The impugned order is set aside, delay condoned and the lower Appellate Court is directed to admit the appeal and dispose of the same in accordance with law. A copy of this order may also be sent to the particular Presiding Officer by name for future guidance that he shall not pass illegal and wooden orders.
3.
The revision petition is allowed.
