Balkrishan Singh And ORS. v. Ranjit Singh
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH CR No.4463 of 2016 Date of decision: 08.05.2018 Balkrishan Singh & ors.
... Petitioners versus Ranjit Singh ... Respondent
CORAM:
HON'BLE MR. JUSTICE AMIT RAWAL
Present:
Mr. Bhavyadeep Walia, Advocate for the petitioners.
Mr. H.R.Bhardwaj, Advocate for the respondent.
***** Amit Rawal, J(Oral) The present revision petition is directed against the orders of the trial Court and the Lower Appellate Court whereby injunction application filed by petitioner-defendant against respondent-plaintiff for not discharging the wastage in front of their house has been declined and application for permanent injunction filed by the respondent-plaintiff for restraining the petitioners-defendants from forcibly and illegally dispossessing him from the suit property has been allowed. The suit is of the year 2015.
Mr. Bhavyadeep Walia, learned counsel appearing for the petitioners has apprised this Court that the suit is pending for plaintiff's evidence.
Without commenting on the merit and demerit of the case whether the injunction granted by the trial Court or the rejection thereof would be in the domain of the trial Court as the order under challenge would always be subject to the final adjudication as anything observed in the order cannot be construed as an expression of merit on the case.
