There is no justification for the petitioner to arrive before this Court to complain that the trial Judge was unjustified in closing the evidence. If there was a further evidence to be given and the defendant would have a reasonable justification to point out that the Court could not have closed the evidence, he was bound to resorting an application before the Court itself and seeking for reopening the case and permission for continuing the evidence. Such power exists with the Court as per the proposition laid down by the Supreme Court and extracted in a judgment of this Court in Santosh Kumar Berry Vs. Nirmala Devi and others 2013(1) PLR 404.
