Dinesh Kumar v. Saroj Rani
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH C.R. No. 4507 of 2015 (O & M) Date of decision: 09.05.2017 Dinesh Kumar ....Petitioner(s)
Versus
Smt. Saroj Rani
...Respondent(s)
CORAM: HON'BLE MR. JUSTICE G.S.SANDHAWALIA
Present:
Mr. Tapan Yadav, Advocate, for the petitioner.
Mr. Prateek Gupta, Advocate, for the respondent.
G.S.SANDHAWALIA, J. (Oral) The petitioner-tenant challenges the order of eviction passed by the Rent Controller, Rohtak dated 27.11.2013 which has been upheld by the Appellate Authority on 04.10.2014.
Counsel for the respondent-landlady has placed on record the order dated 19.09.2015 whereby, the execution petition of the respondent was got withdrawn in view of the fact that the possession had been taken from the judgment debtors.
Mr. Yadav is in no position to rebut this aspect that the possession already stands taken. There was no stay from the year 2014 till today and even notice of motion had not been issued. Resultantly, the present revision has been rendered infructuous and the same is disposed of as such.
