***** GURVINDER SINGH GILL , J .(Oral) CRM-W-192-2024 In view of the reasons mentioned in the application, the same is allowed as prayed for and copy of petition bearing No.CRWP-9182 of 2023 and copy of pictures are taken on record as Annexures A-2 and A-3, subject to all exceptions.

Main Case

1. The petitioners seek issuance of writ in the nature of Mandamus directing the official respondents No.1 to 4 to protect their lives and liberty at the hands of private respondents No.5 to 10.

2. It may here be mentioned that the petitioner earlier had approached this Court by way of filing CRWP-9182-2023 which was disposed of vide order MOHAN SINGH 2024.02.15 06:51 I attest to the accuracy and integrity of this order/judgment

CRWP-566-2024 (O&M) ( 2 ) 2024:PHHC:021495 dated 25.9.2023. However, the private respondents, as arrayed in the earlier petition were different and were not the same as have been arrayed in the instant petition.

3. Learned counsel submitted that the petitioners had submitted a representation (Annexure P-5) dated 11.12.2023, to the Senior Superintendent of Police, Batala seeking protection but no action has been taken thereupon.

4. Having heard the learned counsel for the petitioners, but without commenting anything as regards the veracity of the averments made in the petition, the same is disposed of with a direction to respondent No.3-Senior Superintendent of Police, Batala, to get representation dated 11.12.2023 (Annexure P-5) examined qua the alleged threat perception of the petitioners. In case, it is found that there is genuine threat to life and liberty of the petitioners, then necessary steps as warranted under law be taken thereupon.

5. A copy of this order along with copy of representation dated 11.12.2023 (Annexure P-3) be sent to respondent No.2-Senior Superintendent of Police, Batala for necessary compliance.

6. It is, however, clarified that the aforesaid order shall not be construed as any kind of immunity upon the petitioners, in case it is found that they have committed any wrong.
