The order passed by the Court below is needlessly technical and does not address the cause of justice. The order is untenable. The petitioner will have a right of bringing his witness for cross-examination and the trial will proceed from thereon.

The impugned order is set aside and the revision petition is allowed. I dispense with notice to the respondents, for, I am not entering into the merits of the case but I am only addressing the correctness of the order which is patently untenable. (K.
