(ORAL) The present petition has been filed under Section 439 Cr.P.C. for grant of regular bail in case FIR No. 151 dated 29.10.2021 under Section 25 of Arms Act (Sections 3 & 4 of Explosive Substances Act added later on) registered at Police Station Arniwala, District Fazilka.

Custody certificate dated 27.01.2023 filed by State counsel today in the Court is taken on record.

In paragraph 15 of the petition, the petitioner has mentioned that he has no criminal history. As per custody certificate, State counsel submits that the petitioner has involvement in one more case.

Given above, the present petition is misconceived and the same is dismissed. Liberty reserved to the petitioner to file a fresh petition. State to hand over the custody certificate to the counsel for the petitioner to enable him to file a fresh petition. All pending miscellaneous applications, if any, stand disposed of.
