Learned counsel for respondent Nos.3 to 5 has submitted that the services of the petitioner have since been terminated vide order dated 08.02.2021 (Annexure R-3/8) and hence, the petitioner would need to challenge the said order, in accordance with law. He has further stated that qua the second prayer of the petitioner regarding release of her salary and other emoluments in terms of order dated 01.12.2020 (Annexure P-8) passed by respondent No.2 for the period from June 2020 till her termination order was passed, the said amount would be released within a period of two months.
Faced with same, learned counsel for the petitioner states that he withdraws the present petition qua the first relief claimed by the petitioner i.e. "for issuance of directions to the respondents to allow the petitioner to join her duties on the post of Principal in S.D. Girls Senior YOGESH SHARMA 2021.02.25 08:30 I attest to the accuracy and integrity of this document
CWP-2053-2021 (O&M) -2- Secondary School, District Karnal in pursuance to order dated 01.12.2020 (Annexure P-8) passed by respondent No.2, District Education Officer, Karnal, whereby orders of her reversion dated 08.10.2020 (Annexure P-5) from the post of Principal to the post of TGT issued by the management, has been set aside and resumption of her services as Principal has been ordered along with all consequential benefits" with liberty to challenge the termination order dated 08.02.2021 (Annexure R-3/8), in accordance with law.
Qua the second relief regarding release of salary and other emoluments of the petitioner, learned counsel for the petitioner prays that the present petition may be disposed off in view of the statement made by learned counsel for respondent Nos.3 to 5.
In view of the above, qua the first prayer, petitioner is permitted to withdraw the present writ petition with liberty to challenge the termination order dated 08.02.2021 (Annexure R-3/8), in accordance with law. Qua the second prayer, the present writ petition is disposed off in view of the statement made by learned counsel for respondent Nos.3 to 5 that the salary and other emoluments due to the petitioner would be released within a period of two months from the date of receipt of a certified copy of this order.
Disposed off.
