G.S.SANDHAWALIA, J. (Oral) After arguing for some time, counsel does not press the present petition against the order dated 03.02.2016 passed by the Additional Civil Judge (Sr. Divn.), Amritsar whereby, the matter was referred to the Arbitrator as per Clause 15 of the rent-cum-hypothecation agreement dated 19.06.2013.

Counsel for the petitioner submits that since the suit was for permanent injunction against the forcible possession of the vehicle, he may be given liberty to approach the Arbitrator under Section 17 of the Arbitration and Conciliation Act, 1996 for the necessary relief claimed in the suit.

Keeping in view the challenge not being raised to the impugned order which was passed almost a year back, the petitioner is given liberty to file an appropriate application before the Arbitrator in accordance with law. Disposed of with the above said liberty.
