The defendant who did not pay the costs as directed at the time of filing the written statement belatedly comes with a grievance that his defence has been struck off and the Court has declined to recall that order. The order already passed is set aside on condition of payment of costs of `5000/- instead of `500/- as already directed. The costs will be paid within a period of two weeks from the date of receipt of copy of this order. I dispense with notice to the respondent having regard to the fact that the suit is still reported to be pending and the case is not being disposed of and I have not entered into the merits of the case as regards the respective claims of parties. 2.
