The prayer in the present petition filed under Section 482 Cr.P.C. is for directing respondent Nos. 2 & 3, i.e. the Senior Superintendent of Police, Sirsa and the Station House Officer, Police Station Sadar Dabwali, District Sirsa, to conduct the investigation in FIR No. 14, dated 24.01.2019, under Sections 323, 377, 406, 498-A and 506 IPC read with Section 34 thereof, registered at Police Station Sadar Dabwali, District Sirsa. 2.

Learned counsel for the State referring the status report and contends that after completing the investigation against Bir Singh and Sneh Lata, the
  

 under Section 173 Cr.P.C. was submitted before the learned trial Court, Dabwali, on 21.06.2021. However, the arrest of accused Vikas Roa could not be effected as he had left India and went to Germany. Though in the status report, the State has referred that there is Nitin 2024.07.26 16:32 I attest to the accuracy and integrity of this document

CRM-M-3651-2022 (O&M) treaty between the Republic of India and the Federal Republic of Germany on Extradition but only contends that an application was moved for issuance of warrant of arrest against accused Vikas Rao on 30.10.2023 and after the said application was declined, revision petition was filed before Sessions Court, Sirsa.

Learned State counsel undertakes that the investigating agency shall move under Section 105-B of the Code of Criminal Procedure, 1973 (Section 110 of 'the Bharatiya Nagarik Suraksha Sanhita, 2023') taking appropriate action against accused Vikas Rao within a period of 02 weeks from the receipt of the certified copy of this order. 4.

Keeping in view the statement given by learned State counsel, the present petition stands disposed of.

It is made clear that the State shall remain bound by its statement given in Court today.

Pending miscellaneous application(s), if any, shall also stand disposed of.
