HARINDER SINGH SIDHU, J Prayer is for grant of regular bail in case FIR No.210 dated 26.08.2021 under Sections 15/27-A of NDPS Act registered at P.S City Ratia, District Fatehabad.
As per allegations in the FIR, 18 Kg. of Doda Post were recovered from the petitioner while he was traveling in a car. During interrogation, the petitioner is alleged to have suffered a disclosure statement that he had purchased the contraband from one Ravi @ Bhavya. Petitioner has been in custody since 26.08.2021. Investigation qua the petitioner is complete and the challan has been filed. The petitioner is stated to be involved in three other cases i.e. two under the NDPS Act and one under the Excise Act. In one of those cases, allegation against the petitioner are that he was found in possession of 2 Kg of Doda Post whereas in another case he was found in possession of 10 Kg Doda post. He is stated to be on bail in both the cases. Recovery in the present case is noncommercial. CRM-M-3351 of 2022 #2# and taking into account the custody period coupled with the fact that the trial is not likely to be concluded in near future, without expressing any opinion on the merits of the case, this petition is allowed and the petitioner Satnam Singh alias Sattu is ordered to be released on bail subject to his furnishing bail bonds and surety bonds to the satisfaction of the trial Court/Duty Magistrate concerned.
