The petitioner who was an applicant before the Court below for prosecuting a case for disobedience of the order of injunction had given evidence of himself and witnesses and at the time when the respondent was in the witness box, the applicant appears to have confronted him with affidavit given before the police signed by him. When the respondent denied that he had ever signed an affidavit, the applicant has sought for production of additional evidence by reopening the side to allow for the attestation of Magistrate who alleged to have attested the signature of the respondent. The Court below has not given such permission.

I believe the applicant is overdoing his case and trying to recreate a trial for merely disposing of an interim application which ought to be a summary proceedings. It cannot be taken as if it were a suit and being all the trappings of trial of civil or criminal case and if PANKAJ KUMAR 2015.09.15 14:02 I attest to the accuracy and integrity of this document
