Baldev Singh .............Respondent CORAM: HON'BLE MR.JUSTICE JASWANT SINGH Present:- Mr.Parshotam Lal Singla,Advocate for the petitioner Jaswant Singh,J.(Oral) Petitioner/defendant(vendor) is in revision assailing the order dated 22.12.2014 (P-7) passed by Civil Judge (Junior Division) Jagraon whereby his application for closing evidence of the plaintiff has been disposed of.

It is apparent that the respondent/plaintiff filed a suit for possession by way of specific performance and from the perusal of zimni orders produced at Annexure P-4, availed innumerable opportunities without concluding his evidence. Since the plaintiff had been permitted to lead evidence subject to payment of costs vide order dated 14.11.2014 and costs of Rs.500/- were not paid, defendant moved an application for closing of the evidence for non-payment of costs. Learned trial Court taking note of the fact that the costs were subsequently paid, proceeded to dispose of the application as infructuous.

CR 469/2015 After hearing learned counsel for the petitioner, although no case for interference for ordering closing of the evidence of the plaintiff is made out, however, it is deemed expedient to dispose of the present revision petition with a direction to the learned trial Court to expedite the conclusion of the trial which has been unnecessarily delayed by the plaintiff.

Disposed of in the above terms.
