Civil Revision No.425 of 2019 (O&M) -1IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH Civil Revision No.425 of 2019 (O&M) Date of Order: 21.01.2019 Balvir Singh ..Petitioner

Versus

Jaggo Bai ..Respondent CORAM: HON'BLE MR. JUSTICE ANIL KSHETARPAL

Present:

Mr. L.S.Sidhu, Advocate, for the petitioner.

ANIL KSHETARPAL, J(Oral) Plaintiff-petitioner is in the revision petition against the order passed by learned trial court dismissing the application for temporary injunction which has been affirmed by the learned first appellate court. Admittedly, the land is owned by Central Government which has not been impleaded as party in the suit. Still further, plaintiff claims to be in possession of the property on the basis of an unregistered agreement dated 15.07.2009. Such agreement transferring possessory rights in the immovable property for consideration of Rs.2,62,600/- is not admissible in evidence unless it is registered. Still further the records of right does not prove that the plaintiff is in possession.

In view thereof, there is no scope for interference. The revision petition is dismissed.

Needless to observe that the courts would decide the suit NARESH KUMAR 2019.01.29 11:57 I attest to the accuracy and integrity of this document Chandigarh
