******* SURINDER GUPTA, J.(Oral) Vide order dated 20.11.2015, the provisional rent was allowed to be paid on 01.12.2015. The rent was tendered on 01.12.2015 and the landlord-petitioner has filed this petition with plea that the rent was not tendered on the first date, without challenging the order dated 20.11.2015.

Learned counsel for the petitioner seeks permission to withdraw this petition with liberty to file fresh one on the same cause of action with better particulars and challenging the order dated 20.11.2015 as well.
