The present petition has been filed under Section 438 Cr.P.C., for grant of anticipatory bail to the petitioners, in case FIR No.04 dated 07.01.2016 registered under Sections 323, 341, 506, 379 and 34 IPC (Section 382 IPC added later on) at Police Station Kurali District SAS Nagar. As per the case of prosecution, the petitioners were travelling along with co-accused in a car on the fateful day. After coming out of the car, all the accused including the petitioners encircled the complainant and manhandled him. Thereafter, the accused petitioners took out one pistol of .32 bore along with four cartridges from the car and threatened the complainant of dire consequences.

Learned counsel for the State states that in compliance of order dated 23.01.2023, passed by this Court, the petitioners have joined SONIA BURA 2023.04.17 18:21 I attest to the accuracy and integrity of this document

Learned State counsel on further instructions submits that the fire arm, which was allegedly taken out by the co-accused from the vehicle of the complainant, had since been recovered and handed over to the investigating agency. Learned State counsel further states that the petitioner is not required for further interrogation much less for his custodial interrogation. In view of the above, the petition is allowed and interim order dated 23.01.2023, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C.
