*** Ajay Tewari, J. (Oral) This petition has been filed against the judgment dated 5.4.2004 passed by learned Rent Controller, Chandigarh, which was affirmed by learned Appellate Authority, Chandigarh vide judgment dated 17.7.2006.

After arguing for some time, with the intervention of learned counsel for the parties, this dispute has been settled. On instructions from the respondent learned senior counsel has stated that in case the petitioner allows time, the respondent will vacate the premises voluntarily without forcing the petitioner to file execution petition on or before 31.12.2017. He has further stated that considering the fact that the respondent is ready to vacate the premises voluntarily the SATYAWAN 2016.02.16 12:33 I attest to the accuracy and authenticity of this document High Court Chandigarh

CR-4480-2006 -2petitioner should waive off the rent for the period 1.3.2016 till 31.12.2017.

Learned counsel for the petitioner, on instructions, states that these conditions are acceptable to the petitioner provided the respondent furnishes an undertaking in this behalf before the Executing Court within one month, failing which, the petition should be deemed to be dismissed. This condition is acceptable to the respondent.

In view of the above, this petition is disposed of in these terms.
