Through the instant petition, prayer is made for quashing of FIR No.6 dated 17.01.2022 (Annexure P-1), under Section 420 of the IPC, registered at P.S. Dhariwal, District Gurdaspur, along with all consequential proceedings arising therefrom, on the basis of Compromise (Annexure P-2).

At the very outset, the learned counsel for the petitioner submits that though the matter has been compromised inter se the parties, which led to institution of the instant petition, however, in the meantime, the demise of the complainant occurred. Therefore, he seeks leave to withdraw the instant petition, however, with liberty to re-access this Court on the same cause of action, at a subsequent stage, in case a compromise is effected inter se the petitioner and the LRs of the deceased complainant.

Leave granted.

Consequently, the instant petition is dismissed, however, with liberty (supra).
