The present petition has been filed for grant of parole, which has been denied vide order dated 05.09.2025 by raising the apprehension that release of the petitioner is likely to breach the peace and the security of the State. 2.

At the outset, learned counsel for the State submits that he has received a communication dated 08.04.2026 from the SHO, Thana Purana Shala that keeping in view the review done regarding the case of the petitioner, there is no security threat to anyone, in case the parole is granted by the State. 3.

Keeping in view the fact that in the impugned order dated 05.09.2025 on the basis of the apprehension that the peace and security of the threat is likely to be compromised, the same was denied by District Magistrate Gurdaspur which reasons have been reviewed so as to come to a different conclusion that there is no threat to the peace or the security of the State at the hands of the petitioner, in case VANITA 2026.04.10 14:14 I attest to the accuracy and authenticity of this order and judgment

CRWP-606-2026 parole is granted, hence, keeping in view totality of facts presented before us the Jail Authorities are directed to grant the parole of eight weeks to the petitioner. The State will be within its jurisdiction to impose requisite terms and conditions to ensure that the petitioner behaves properly outside the jail premises and also to ensure that he surrenders after completing the period of parole. 4.

Let the said order be passed within a period of two weeks from the receipt of certified copy of this order.
