Petitioner has filed this second petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.21 dated 31.03.2018 under Section 420 IPC, registered at Police Station Jhulka, District Patiala. I have heard learned counsel for the petitioner and have gone through the record.
From the record, I find that the first petition for anticipatory bail filed by the petitioner has already dismissed on merits by this court vide order dated 07.08.2018. It is specifically ordered by this Court in that order that the petitioner has not complied with the order dated 23.04.2018 passed by this Court. He has neither surrendered the passport nor filed any affidavit, as directed. Otherwise also, the allegation against the petitioner is regarding cheating etc. Now, learned counsel for the petitioner has VINEET GULATI 2019.01.22 14:28 I attest to the accuracy and authenticity of this document Chandigarh contended that petitioner is ready to surrender the passport. No other new
CRM No.M-2544 of 2019 -2fact has been brought to the notice of this Court. Keeping in view the facts and circumstances of the present case, I find that no ground is made out this time also for grant of anticipatory bail to the petitioner.
Therefore, finding no merit in the present petition, the same is dismissed.
