Petitioner has filed this petition under Article 227 of Constitution of India challenging the order dated 16.7.2015 (Annexure P-7) whereby petition filed by the petitioner under Section 24 of the Code of Civil Procedure, 1908 for transfer of appeal titled 'G.S. Bhatty vs. Paramjit Singh' from the Court of Sh. S.K.Sachdeva, Appellate Authority to any other Court of competent jurisdiction, was dismissed.

Notice of motion.

At this stage, Mr. J.K.Khetarpal, Advocate has appeared and accepted notice on behalf of the respondent and has submitted that he has no objection if the appeal in question is transferred from the Court of Sh. S.K.Sachdeva, Appellate Authority to any other Court of competent jurisdiction.

Civil Revision No. 4779 of 2015 (O&M) -2the petitioner from the premises in question. The said petition was allowed by the Rent Controller and appeal against the said order is pending in the Court of Sh. S.K.Sachdeva, Appellate Authority. Petitioner had sought transfer of the appeal from the Court of Sh. S.K.Sachdeva, Appellate Authority to any other Court of competent jurisdiction as the dispute between the respondent and his brother qua title of the demised premises had been decided by the said Court.

Since the petition has not been opposed by the counsel for the respondent, the same is allowed. Rent Appeal No. 184 of 18.7.2014 titled 'G.S.Bhatty vs. Paramjit Singh' pending in the Court of Sh. S.K.Sachdeva, Appellate Authority is withdrawn from the said Court and the learned District and Sessions Judge shall transfer the same to any other Court of competent jurisdiction.
