3.

Whether the judgment should be reported in the Digest? -.- K. KANNAN J. (ORAL) 1.

There is no scope for interference with an order passed by the lower Appellate Court while considering an application filed by the landlord for determination of mesne profits. The tenant had benefit of order of stay despite an order of eviction issued against him. While deciding the application, amongst the documents filed by the respective parties, the Appellate Court gave credence to the registered sale deeds in respect of properties in the adjoining sectors. The tenant was relying on the unregistered documents and the Court did not find them worthy of acceptance. Looking at a registered document that provided for a rental of ` 40,000/- in an adjoining sector, the Appellate Court was fixing mesne profits by ` 40,000/-. The Court has given adequate reasons for disposing of an application and I will find no merits for interference with the order passed by the lower Appellate Court. 2.

The revision petition is dismissed.
