Present revision petition has been filed by the petitioner/defendant No.1 seeking setting aside the impugned order dated 07.04.2018 passed by the learned Additional Civil Judge, Senior Division, Baba Bakala Sahib, Amritsar (Annexure P/2), whereby the defence of the petitioner/defendant No.1 has been illegally struck off.

Present petition is of the year 2018. Order sheets reveal that from the last two dates of hearing i.e. on 09.12.2022 and 14.03.2023, there was no representation on behalf of the petitioner. Accordingly, on the last date of hearing i.e. on 14.03.2023, Registry was directed to inform learned counsel for the petitioner. Pursuant thereto, office report dated 18.08.2025 has been received, as per which learned counsel for the petitioner has been duly informed about the date fixed. Despite that, none has put in appearance on behalf of the petitioner today as well.

In view of the aforesaid premise, issuance of fresh notice to the petitioner would be futile exercise. It appears that due to sheer long pendency of the present petition before this Court for a period of more than 07 years, the petitioner has lost interest in pursuing the same, as no attempt has been made by him to contact his counsel or to engage a new counsel. It is, therefore, clear that the petitioner is not seriously interested in pursuing the present matter. 4.
Moreover, vide order dated 27.10.2022 passed by the learned trial Court (downloaded from official e-Courts website), the main civil suit bearing No.CS/201/2017 has also been dismissed in default, rendering the present petition as infructuous.

Accordingly, the present petition is disposed of as having been rendered infructuous.
