ANIL KSHETARPAL, J(Oral) The dispute in the present revision petition is as to how much court fee is payable on the relief of possession. On the directions of the court, plaintiff has already fixed court fee valuing the property on the basis of conveyance deed. On the other hand, defendant objects and has submitted that the value of the property is approximately Rs.1 crore and, therefore, the suit is liable to be dismissed.
In the considered opinion of this court, insufficiency of court fee, cannot be the ground to reject the plaint at this stage. Defendant can claim an issue and the court after permitting the parties to lead evidence would adjudicate upon the same.
In view of the aforesaid, there is no ground to interfere with the orders under challenge.
