IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH CR No.470 of 2013 (O&M) Date of Decision:- 7.5.2018 Rajinder Kaur ... Petitioner
Versus
Brig. Inderpreet Singh Gill ... Respondent
CORAM:

1.
The present revision petition had been filed by the tenant challenging order dated 3.12.2012 passed by learned Rent Controller, SAS Nagar, whereby ejectment of the petitioner/tenant has been ordered. However, when the revision petition was taken up for hearing on the first date i.e. on 23.1.2013, the tenant restricted his plea to extension of time for vacating the premises. The order dated 23.1.2013 is reproduced below for the sake of ready reference :- Order dated 23.1.2013 "Limited plea raised by the tenant petitioner before this court is that time for vacating the premises may be enlarged. Notice of motion for 21.2.2013.
Status quo regarding possession be maintained till the next date of hearing. This order shall, however, be restricted to the next date."

(2) CR-470-2013 (O&M) 2.
Vide impugned order dated 3.12.2012, the petitioner had been directed to hand over vacant possession of the demised premises within two months. However, it is not in dispute that pursuant to issuance of warrants of possession, the possession of the demised premises has been delivered to the landlord on 9.5.2013. Consequently, the possession having already been handed over, the present revision petition is rendered infructuous and is dismissed as such.
