This order of mine shall dispose of two revision petitions bearing CR No.479 of 2016 titled as "Gulshan Kumar V/s Pt. B.D. Sharma University of Health Science Rohtak and others" and CR No.565 of 2016 titled as "Sanjay Kumar V/s Pt. B.D. Sharma University of Health Science Rohtak and others" filed against the impugned order dated 09.12.2015.
YOGESH SHARMA 2018.12.20 10:42 I attest to the accuracy and integrity of this document CR Nos.479 and 565 of 2016 (O&M) Concededly the appeal preferred against the order of eviction initiated under the Haryana Public Premises Act, is pending adjudication before the Commissioner, but there was no interim stay, resulting into, the execution. In these circumstances, the petitioner has approached this Court and this Court on 25.01.2016 passed the following order:- ''Notice of motion, for 23.04.2016.
Interim stay of the impugned order subject to the condition that the petitioner pays Rs.60,000/- per month from today, 1st payment of which will fall on or before 05.02.2016. The said amount shall be paid till the disposal of the revision petition. The manner of how this additional amount will be treated will abide by the final directions given by this Court at the time of the final disposal of the civil revision. If the amount is not paid as directed, the interim stay granted will stand vacated.'' The factum of pendency of the appeal is not in dispute. It would be in the fitness of things and interest of justice, the present revision petitions are disposed of with a direction to the Commissioner to decide the appeal in accordance with law as expeditiously as possible preferably within a period of three months from the date of receipt of the certified copy of this order,. In the meantime, interim order dated 25.01.2016 granting the interim stay is ordered to be continued, subject to the conditions as indicated in the order.
