Present:
Mr. Manoj Kumar Sood, Advocate for the petitioner.
CORAM:HON'BLE MR. JUSTICE K. KANNAN 1.
Whether Reporters of local papers may be allowed to see the judgment ?
2.
To be referred to the Reporters or not ?
3.
Whether the judgment should be reported in the Digest? -.- K. KANNAN J. (ORAL) 1.
The amendment to the written statement was sought to be brought during the course of trial when all the evidence was complete bringing out the details of earlier proceedings which are under challenge. Though there is only a limited jurisdiction available for the amendment under Order 6 Rule 17 CPC, there is a discretion to be exercised for a defendant, for amendment to the written statement varies from the amendment of pleading sought at the instance of the plaintiff. The Court has exercised the discretion available which I do not think has resulted in any prejudice to the plaintiff. 2.
The revision petition is dismissed.
