The petition for recall of the order closing the respondent's evidence was dismissed. The Tribunal while dismissing the application has observed that the petitioner had availed six opportunities to file his evidence and only when there was no evidence, he had closed his case and there was no ground made for recall of the witness. 2.

The counsel for the petitioner says that the lawyers were boycotting for last three hearings and therefore, he could not produce his evidence. I do not find any such ground made. I wanted to assure to myself that there was some case made before me enabling the petitioner to have an opportunity for letting in evidence. He says that he is registered owner of the vehicle and admittedly, the vehicle had been involved in the accident. He had not even insured the vehicle. He will have no luxury of endless trial in a situation where at least, prima facie, it seems that there was any hardly any defence to offer.
