The petitioner's prayer for recalling Smt. Kailash Rani for further cross-examination has been dismissed by the trial Court. The proceedings under Order IX Rule 13 of the Code of Civil Procedure, 1908, are pending before the trial Court. Smt.Kailash Rani appeared in evidence. The learned counsel representing the applicant was permitted to crossexamine the witness. The trial Court has held that the applicant has failed to make out a case for recall of the witness for further cross-examination. 2.
The learned counsel representing the petitioner has failed to draw the attention of the Court to any substantive error or perversity in the impugned order.
