CORAM : HON'BLE MRS. JUSTICE ALKA SARIN Present :

Mr. Prateek Gupta, Advocate for the petitioner. Mr. Sandeep Khunger, Advocate for respondent No.1. Mr. Gaurav Gurcharan Singh Rai, Advocate for respondent No.3.

ALKA SARIN, J. (ORAL) CM-14437-CII-2024 1.

The present application has been filed for impleading the subsequent purchaser/transferee pendente lite as a respondent. 2.

Mr. Sandeep Khunger, Advocate for respondent No.1 states that he has no objection as the landlord has sold the property in favour of Sh. Shobhit Gupta who is sought to be impleaded as a party. 3.

For the reasons stated in the application, the same is allowed. Sh. Shobhit Gupta is ordered to be impleaded as respondent No.3. Amended memo of parties is also taken on record. Registry to scan and tag the same at an appropriate place.

CR-447-2018 4.

CR-447-2018 (O&M) --2-- has since sold the property in favour of Sh. Shobhit Gupta who has now been impleaded as a party respondent No.3. Learned counsel further states that on 30.08.2019 the petitioner herein was directed to deposit the arrears of rent w.e.f. January 2009 till the period he started depositing the rent pursuant to order dated 23.01.2018 within a week and the said amount was to be kept in an FDR. Learned counsel would further contend that in view of the fact that the present petitioner is withdrawing the present revision petition, the amount which has been deposited in the FDR be released in his favour. Learned counsel for respondent No.1 states that he has no objection as he has no interest left in the property having sold the same to Sh. Shobhit Gupta respondent No.3 during the pendency of the revision petition.

Learned counsel appearing on behalf of the newly impleaded respondent No.3 Sh. Shobhit Gupta states that he would have no objection if the present petition is permitted to be withdrawn and the amount deposited in the FDR is released in favour of the petitioner.

5.

In view of the statements made by learned counsel for the parties, the present revision petition is dismissed as withdrawn. The amount deposited pursuant to order dated 30.08.2019, which has been invested in a FDR, be released in favour of the petitioner herein. Pending applications, if any, also stand disposed off.
