Compromise dated 14.12.2018, Annexures R1, is permitted to be taken on record.

CM-27728-CII-2018 The tenant was in revision against the concurrent finding recorded by the authorities below whereby he was evicted from the demised premises on the ground of personal necessity. This Court while issuing notice of motion vide order dated 8.9.2010, had stayed the eviction of the petitioner. Subsequently, on 8.4.2011, the revision was "admitted". Interim order was continued.

Thereafter, on an application filed by the landlord for mesne profits, order dated 13.11.2018 was passed in CM-5909-CII-2017, whereby mesne profits were enhanced @ Rs.10/- per sq. foot i.e. Rs.4800/- approximately apart from the rent of Rs.750/- per month. Now, the aforementioned misc. application has been instituted by the respondent/landlord seeking disposal of the main revision itself in view of the written compromise dated 14.12.2018, Annexure R1, having been executed between the parties.

Upon notice of the application, Ms.Seema Arora, Advocate, accepts notice and acknowledges the contents of the compromise and has no objection for dismissal of the main revision in terms of compromise dated 14.12.2018, Annexure R1.

In view of the aforesaid agreed stand, the misc. application is allowed.

CR-5742-2010 The main revision petition is disposed of in terms of the written compromise dated 14.12.2018, Annexure R1. The parties shall be bound by the terms of the compromise.
