Savita Devi v. Naveen Kumar
CR No.4917 of 2016 {1}
IN THE HIGH COURT OF PUNJAB & HARYANA
AT CHANDIGARH CR No.4917 of 2016 Date of decision:05.08.2016 Savita Devi ... Petitioner Vs.
Naveen Kumar ... Respondent
CORAM:
HON'BLE MR. JUSTICE AMIT RAWAL Present:- Mr. H.P.S.Ishar, Advocate for the petitioner.
AMIT RAWAL J. (Oral) Petitioner-wife is seeking enhancement of maintenance pendente lite to the tune of `15,000/ instead of `5,000/- and litigation expenses `20,000/- instead of `5,000/- as awarded by the Court below. Mr. H.P.S.Ishar, learned counsel appearing on behalf of the petitioner-wife submits that admitted income of the respondent is `42,000/- and the Court below has erred in awarding meager amount of maintenance. Perusal of salary certificate, Annexure P-3 shows that after deduction the carry home salary of the respondent is `28,586/-. Admittedly, the children are living with the husband. I am of the view that a sum of `5,000/- for a single lady is sufficient.
In view of the aforementioned, I do not intend to differ with the findings rendered by the Court below, much less, the impugned order cannot be said to have been passed without jurisdiction. Savita 2016.08.10 13:47 I attest to the accuracy and integrity of this document High Court Chandigarh
CR No.4917 of 2016 {2} Accordingly, the revision petition stands dismissed. However, a liberty is granted to the petitioner to move an appropriate application as and when certain facts surface with regard to increased income of the husband.
