There is no justification for the defendant, whose side was closed, to come to this Court saying that one more opportunity may be given. If he had valid justification for not being present on the day when the case was posted on 08.07.2015, the petitioner has the liberty to state the said reasons for his non-appearance through an application and seek for reopening of the case and for permission to let in evidence. The procedure as to how the matter shall be dealt with by the Court below has been set forth by this Court in Santosh Berry Vs. Nirmala Devi and others 2013(1) PLR 404. If such a prayer is sought before the Court by moving an application, the Court will consider the same and pass appropriate orders.

The revision petition is dismissed as not competent but with liberty as mentioned above.
