Counsel for the petitioner had contended that the petitioner is ready to make the payment. Accordingly, the case was adjourned for today. However, today counsel for the petitioner has very fairly stated that the petitioner is not coming forward to make the payment. Counsel prays that he may be permitted to withdraw the present petition with liberty to file fresh one if the petitioner agrees to pay the amount as decreed by the Court. In view of the prayer made by counsel for the petitioner, the present petition is dismissed as withdrawn with liberty as prayed for.
